Colorado Food Delivery Drivers, Are you covered for an Auto Accident?

Almost all personal lines auto insurance policies exclude ‘delivery’ from their policies, even if you have a ‘business use endorsement’.   Commercial auto policies need to be written with a ‘delivery’ exposure to ensure coverage due to an accident involving a driver delivery goods to the public.

But during the current Covid-19 pandemic, restaurants have been hiring drivers by the hundreds to deliver food, medicines, and personal items to shut in Coloradans.   This created a huge explosion of new drivers on the road who potentially have no insurance in case they are in an ‘at fault’ accident.

Governor Polis and  The Colorado Dept of Insurance recognized this problem early on and issued a temporary,Emergency Regulation (20-E-03) which requires insurers to cover these drivers and dictates coverage that has to be provided under the various auto policies types available.

The temporary, emergency regulation will stay in place as long  Public Health Order (PHO20-22) is in effect which closes down restaurants, bars, cafes and coffee shops.

In normal times, getting ‘delivery’ car usage covered under an auto insurance policy is tricky and expensive, whether it is a commercial or personal lines insurance policy.
